*** Parade Waiver *** The undersigned wishes to participate in the 4th of July Parade to be held July 4, 2022. The undersign acknowledges that it has been notified by the Fairport-Perinton Chamber of Commerce to be insured against any and all risk involved with participation in said parade. The undersigned also acknowledges that he/she assumes all risks involved in connection with its participation in said parade. The undersigned agrees to waive any and all claims or rights of action it may have against the Fairport-Perinton Chamber of Commerce, the Town of Perinton, the Village of Fairport or its members for damages incurred as a result of its involvement in said parade.
The undersigned is familiar with federal, state, and local laws, orders, directives, and guidelines related to COVID-19 (hereinafter referred to as the “Disease”), including the Centers for Disease Control and Prevention (CDC) guidance on the Disease. The undersigned will comply with all such orders, directives, and guidelines while involved with the parade, including, without limitation, requirements related to hand sanitation, social distancing, and use of face coverings. The undersigned will also follow all instructions of the Chamber of Commerce, Town of Perinton, and/or the Village of Fairport while involved with any and all parade activities. The undersigned confirms that no person involved with the parade as a part of their individual entry or organizational entry, will be experiencing symptoms of the Disease (such as [cough, shortness of breath, or fever] do not have a confirmed or suspected case of the Disease, and have not come in contact in the last 14 days with a person who has been confirmed to have or suspected of having the Disease.
The Undersigned hereby expressly waives and releases any and all claims, now known or hereafter known, against the Chamber of Commerce, and its[ officers,][ directors,][ manager(s),] employees, agents, affiliates, [shareholders/members][,] successors, and assigns (collectively, "Releasees"), on account of injury, illness, disability, death, or property damage arising out of or attributable to my being on the Premises or engaging in the Activity and being exposed to or contracting the Disease, whether arising out of the ordinary negligence of the Company or any Releasees or otherwise. I covenant not to make or bring any such claim against the Company or any other Releasee, and forever release and discharge the Company and all other Releasees from liability under such claims. This waiver and release does not extend to claims for gross negligence, willful misconduct, or any other liabilities that New York State law does not permit to be released by agreement.
The undersigned shall defend, indemnify, and hold harmless the Perinton Fairport Chamber of Commerce for any and all losses, damages, liabilities, deficiencies, claims, actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses of whatever kind, including attorney fees, fees, the costs of enforcing any right to indemnification under this Release, and the cost of pursuing any insurance providers, [incurred by/awarded against the Company [or any other Releasees] [in a final [non-appealable] judgment],] arising out or resulting from any claim of a third party related to the Disease due to my engaging in the Activity or being on the Premises, including any claim related to my own negligence or the ordinary negligence of the Chamber.

*** The 2023 parade will form at 9:30 am on the corner of Whitney Rd and Main Street, utilizing Whitney Rd as staging points. At 10:00 am the parade will proceed south on Main Street, turn west on W. Church Street and end at Perinton Park. After your application has been submitted we will email your position number and approximate lineup location. ***
