When Should You Update Your Estate Plan?

Your estate plan should never be set in stone. A good estate plan evolves over time, based upon changes to your health, assets, family relationships, and new laws. All of these changes can drastically alter the intent of the plan that you currently have in place. Not making the appropriate adjustments can quickly lead to the old adage that failing to plan, is planning to fail.

If you own any form of personal or real property, you automatically have an estate plan. Owning property jointly with another individual with rights of survivorship will cause the ownership of the property to transfer to the joint owner upon your passing. Resolving Disputes: What's The Best Way?

Whether you own a business or run a household, inevitably you will find yourself in a dispute: a contractor's work is incomplete or unsatisfactory; a property owner refuses to pay for work performed; a financial advisor or broker fails to properly advise and invest in accordance with your needs or instructions: a nursing home resident and family have concerns about the quality of care being given; a resident's family fails to honor their agreement to pay timely for the care and services that an aging parent is receiving.

How are—or should—these disputes be resolved? In our system of civil justice, there are essentially three ways to accomplish this, all of which avoid a "duel at 20 paces," which did not work out very well for Alexander Hamilton in 1804. Not In My Backyard! Why Neighbors Think They’re Being Ignored: An Update

Public hearings, where neighbors plead with a planning or zoning board to deny an application, are common. Often, the neighbors bring up good points that help improve a project. But sometimes neighbors raise concerns that later seem to be ignored by the board. Get to Know MCCM Partner Michael F. McConville - Why did you become a lawyer?

A Partner’s Perspective on Michael F. McConville...

"I’ve had the privilege of being Mike’s law partner since 1980. Forty-four years is a long time to work closely with anyone, but it has allowed me to make these observations to share with you about who Mike is, and what he has meant to our firm and our clients. So, while later in this article we let Mike share in his own words how he became a lawyer, it is important that you first get an insider’s perspective on who I know him to be as a person and trusted “attorney and counselor at law”—because Mike will never “toot his own horn” about what he does and what he has accomplished." Over 11,000 tickets were sold, raising over $11,000 for the Fairport Foundation, a local non-profit dedicated to enhancing the quality of life in Perinton and Fairport. Visitors flocked from across the country and Canada to enjoy these performances!

Why Push-Ups are Essential for Your Athlete’s Development

Push ups are exercises that “seem” easy, but are complex. Many variations can make the push-up much harder, if done right.

When athletes come to Fit Strength Performance and attempt push-ups, they often struggle to complete 10 or more, due to poor form.

Performing push-ups with proper form is vital for many reasons.

  1. Proper upper body mobility and posture.
  2. Core strength.
  3. Hip range of motion: Athletes often let their belly hit the ground in push-ups. This causes an anterior pelvic tilt that can limit hip range of motion, but also cause back pain.
  4. Functional upper-body strength

Push-ups earn upper body and core strength and increase hip and upper-back range of motion.

Try these push-up variations. You'll feel your upper body work and your hips, hamstrings, and lower and upper back will feel great!

  1. Yoga Push-Up
  2. Off-Set Push-Up with Posterior Expansion
